1. Acceptance of Terms:

 

By accessing or using our Website and consignment services, you agree to abide by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.

 

2. Consignment Services:

 

We offer consignment services to help you sell your sports cards, collectibles, and memorabilia through our eBay store. By engaging with our services, you agree to the terms outlined in our terms & conditions.

 

3. Customer Portal Dashboard:

 

Our customer portal dashboard allows you to review your live auction items, generate payout reports, track packages, and create consignment forms. Your use of the dashboard is subject to these Terms.

 

4. User Accounts:

 

To access certain features, you may need to create a user account. You are responsible for maintaining the confidentiality of your account information and agree to notify us immediately of any unauthorized use of your account.

 

5. Merch Store and Shark Coins:

 

In our merch store, you can purchase Slab Sharks branded clothing using Shark Coins earned through consigned items. Transactions in the merch store are governed by these Terms.

 

6. Affiliate Programs:

 

We are a participant in the eBay Partner Network. Clicking on affiliate links and making purchases may earn us a commission. This does not impact the price you pay for an item.

 

7. Use of Website:

 

You agree to use the Website and services for lawful purposes only. You may not use the Website in a way that violates any applicable laws or regulations.

 

8. Privacy:

 

Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

 

9. Intellectual Property:

 

The content on our Website, including logos, text, and images, is protected by intellectual property laws. You may not use, reproduce, or distribute our content without our explicit consent.

13. Shilling/Bidding on your items:

By engaging in any transaction on our eBay store (“the Store”), you agree to comply with these Terms & Conditions, including the prohibition on shilling and self-bidding.

 

13. A) Definitions:

 

Shilling: The act of artificially inflating the price of an item through deceptive or fraudulent means, including but not limited to, placing fake bids, or using secondary accounts to bid on one’s own items.

 

Self-Bidding: Placing bids on your own items listed on the Store with the intent to manipulate the bidding process and drive up the price.

 

13. B) Prohibition of Shilling and Self-Bidding:

 

It is strictly prohibited for sellers or any affiliated parties to engage in shilling or self-bidding on items listed on the Store. Such activities undermine the integrity of the bidding process and violate eBay’s policies.

 

13. C) Consequences of Violation:

If we determine that a seller or any affiliated parties have engaged in shilling or self-bidding, we reserve the right to take the following actions:

 

· Cancel the auction or sale.

· Suspend or terminate the seller’s account.

· Report the violation to eBay for further investigation.

· Pursue legal action for damages resulting from the violation.

 

13. D) Reporting Violations:

Buyers and other users who suspect or observe any shilling or self-bidding activities are encouraged to report such incidents to us promptly. Reports should include relevant details, such as item numbers, user IDs, and a description of the suspicious behavior.

 

13. E) Educational Resources:

We encourage sellers to familiarize themselves with eBay’s policies and guidelines regarding shilling and self-bidding. eBay provides educational resources and materials to help users understand and comply with their policies.

 

14. Consignment submission:

 

14.1 Slab Sharks Inc., reserves the right to reject any items based on a variety of factors including, suspicion of alterations, trimming, recolouring, authenticity issues and other factors.

 

14.2 Once an item is consigned, the item will be placed in the queue to be auctioned in our earliest weekly auction. Slab Sharks Inc., reserves the right to move a consignment to the following week for optimal auction results – the consignor will be notified.

 

14.3 Once Slab Sharks Inc. receives a consignment, Slab Sharks Inc. will only return the items back to the consignor on request, if the item is unpaid via the eBay platform and relisted for two auctions in a row for a total of 3 auction attempts.

 

14.4 If there are no requests to return the consigners items, the consigners’ items will continue to be relisted indefinitely or as Slab Sharks Inc., deems fit. Return shipping is to be paid by the consignor.

 

14.5 All items are listed in our Thursday night weekly auction. The auction slot may begin at 6pm EST and may end at 12:30 am EST. All auctions start at .99 cents, unless otherwise negotiated at no reserve 7-day auctions. As a consignor you understand the merits of an auction and that the highest paid bidder is the rightful owner of the card after an auction.

 

15. Authenticity and Originality

 

15.1 The Consigner represents and warrants that all submitted Items are knowingly genuine, unaltered, and not stolen.

 

15.2 The Consigner acknowledges that any attempt to knowingly submit trimmed, altered, or stolen Items is strictly prohibited. 13.3 If a Consigner unknowingly submits an unauthentic, altered, or stolen item – the Company reserves the right to obtain personal information from the consigner regarding the item(s) in question, including but not limited to, the provenance of the items and the history of the purchase.

 

15.3 In the event that an item is deemed to be unauthentic, altered, or stolen, the item(s) is to be suspended from auction for 1 auction week. In that time, an investigation will ensue to determine if the item(s) may be relisted.

 

 

16. Inspection and Verification

 

16.1 The Company reserves the right to inspect and verify the authenticity of each submitted Item.

 

16.2 If, during the inspection process, an Item is discovered to be trimmed, altered, or stolen, the Company will notify the appropriate persons or authorities.

 

16.3 The Consigner acknowledges that the Company may use advanced methods and technologies to verify the authenticity of Items, including but not limited to, expert opinions and authentication services.

 

17. Legal Consequences

 

17.1 If the Company discovers that an Item has been knowingly submitted in violation of these terms and conditions, the Consigner may be subject to legal consequences, including but not limited to civil and criminal liability.

 

17.2 The Consigner agrees to indemnify and hold the Company harmless from any claims, damages, or liabilities arising from the submission of any trimmed, altered, or stolen Items.

 

18. Disqualification and Termination

 

18.1 If an Item is found to be trimmed, altered, or stolen, the Company reserves the right to disqualify the Consigner from the consignment program.

 

18.2 The Company may terminate any consignment agreement with immediate effect if the Consigner breaches these terms and conditions.

 

19. Notification

 

19.1 In the event that an Item is discovered to be trimmed, altered, or stolen, the Consigner will be promptly notified.

 

19.2 The Company reserves the right to report any illegal activities related to submitted Items to the relevant law enforcement agencies.

 

20. Amendments

 

The Company reserves the right to amend these terms and conditions at any time. Consigners will be notified of any changes, and continued participation in the consignment program constitutes acceptance of the revised terms.

 

21. Unaware Submission

 

21.1 In the event that a Consigner submits an Item without prior knowledge that it is trimmed, altered, or stolen, the Consigner must promptly inform the Company upon becoming aware of such circumstances.

 

21.2 The Consigner understands that unintentional submission of a trimmed, altered, or stolen Item does not absolve them from the consequences outlined in above sections. The Consigner may be required to speak to parties, including but not limited to, law enforcement agencies. The Consigner understands that if an item submitted is one obtained by criminal activity, the item may be confiscated by law enforcement agencies.

 

21.3 The Company, at its discretion, may consider the circumstances surrounding an unintentional submission and may take them into account when determining appropriate actions, including but not limited to disqualification or termination.

 

21.4 The Consigner agrees to cooperate fully with the Company in any investigation or verification process related to the unintentional submission.

 

21.5 The Company may, at its sole discretion, work with the Consigner to resolve the situation, provided the Consigner acts in good faith and cooperates with any remedial measures deemed necessary by the Company.

 

21.6 The Consigner acknowledges that the Company may still report any unintentional submission of altered, trimmed, or stolen Items to the appropriate authorities if required by law.

 

22. Good Faith Participation

 

22.1 Consigners are expected to participate in good faith, providing accurate information about the submitted Items to the best of their knowledge.

 

22.2 The Company recognizes that mistakes can occur, and Consigners are encouraged to communicate openly and promptly if they become aware of any issues with their submitted Items.

 

22.3 By submitting consignment cards or collectible items, the Consigner acknowledges that they have read, understood, and agreed to these additional provisions related to unaware submissions.

 

23. Amendments to Terms & Conditions:

We reserve the right to amend these Terms & Conditions at any time and continued use of the Store constitutes acceptance of the modified terms.

 

24. Governing Law:

 

24.1 These Terms & Conditions are governed by the laws of Ontario, Canada and any disputes arising from or related to these terms will be subject to the exclusive jurisdiction of the courts in Ontario.

 

24.2 By using our eBay Store, you acknowledge that you have read, understood, and agree to abide by these Terms & Conditions, including the prohibition of shilling and self-bidding. Violation of these terms may result in serious consequences, as outlined above.
